Discope Terms of Service

Note: This is a translated version of Discope's Terms Of Service. If there is any contradiction between the Japanese and English versions, the Japanese version shall take precedence.
These Terms of Service (hereinafter referred to as "the Terms") stipulate the conditions for using the services (hereinafter referred to as "the Service") provided on this website by Discope (hereinafter referred to as "the Group"). Registered users (hereinafter referred to as "Users") are required to use the Service in accordance with the Terms.
Article 1 (Application)
- The Terms apply to all relationships related to the use of the Service between the User and the Group.
- In addition to the Terms, the Group may establish various rules and regulations (hereinafter referred to as "Individual Provisions") regarding the use of the Service. Regardless of their name, these Individual Provisions shall form part of the Terms.
- In the event that the provisions of the Terms conflict with the Individual Provisions, the Individual Provisions shall prevail unless otherwise specified in the Individual Provisions.
Article 2 (User Registration)

To use the Service, a registration applicant must agree to the Terms, authenticate via Discord OAuth2, and apply for registration using the method prescribed by the Group. The registration is completed when the Group notifies the applicant of its approval.

The Group may refuse to approve a registration application if it determines that the applicant has any of the following reasons, and it is under no obligation to disclose the reasons.
- If false information was provided in the registration application
- If the applicant has previously violated the Terms
- If the Group deems the registration inappropriate for any other reason

Applicants must authenticate using their Discord account via OAuth2. The Group will properly manage the User's Discord account information and strive to prevent it from leaking to third parties. However, the Group assumes no responsibility for any problems, losses, or damages arising from the security of Discord itself.
Article 3 (Account and Data Management)
- Users are responsible for properly managing their Discord account information.
- Users may not transfer, lend, or share their Discord account with third parties under any circumstances. The Group will consider any use authenticated through a Discord account as use by the registered User themselves.
- The Group assumes no responsibility for any damage caused by the use of a Discord account by a third party, except in cases of willful misconduct or gross negligence by the Group.
- If a User grants other users actual authority to change various settings of their Discord server, the User who owns the Discord server will bear full responsibility for any actions taken by the authorized user on the server.
Article 4 (Service Fees and Payment Methods)
- When using the paid portions of the Service, Users shall pay the usage fees specified separately by the Group and displayed on this website using the method designated by the Group.
- If a User delays payment of the usage fees, the User shall pay late damages at a rate of 14.6% per annum.
Article 5 (Prohibited Activities)
Users must not engage in any of the following activities when using the Service:
- Using the Service in ways not officially guided or indicated by the Service
- Engaging in malicious activities such as exploiting bugs or defects in the Service
- Excessive access to the Service using programs or other means
- Posting Discord servers that fall under any of the following categories:
- Discord servers that violate laws or public order and morals
- Discord servers related to criminal activities
- Discord servers that violate the Discord Terms of Service
- Discord servers that violate the Discord Community Guidelines
- Discord servers without defined content or deemed to lack content
- Discord servers intended to lead or invite users to another specific server, or both
- Discord servers that disrupt or interfere with the Service or other Discord servers, including those that engage in so-called "trolling"
- Any other Discord servers that violate the Group's regulations or deemed inappropriate by the Group
- Any other activities deemed inappropriate by the Group
Article 6 (Changes to Service Content)
The Group may change, add, or discontinue the content of the Service with prior notice to Users, and Users shall agree to this.
Article 7 (Suspension of Service Provision)

The Group may suspend or interrupt the provision of all or part of the Service without prior notice to Users if it determines any of the following:
- When performing maintenance or updates on the computer system related to the Service
- When the provision of the Service becomes difficult due to force majeure events such as earthquakes, lightning, fires, power outages, or natural disasters
- When the computer or communication lines are stopped due to an accident
- Any other circumstances where the Group determines that providing the Service is difficult

The Group assumes no responsibility for any disadvantages or damages incurred by Users or third parties due to the suspension or interruption of the Service.
Article 8 (Copyright)
- Users may use, post, or upload only information for which they own the necessary intellectual property rights or have obtained the necessary permissions from the right holders, such as texts, images, and videos.
- The copyrights for texts, images, videos, etc. that Users post or upload using the Service are retained by the Users or the existing rights holders. However, the Group may use the posted or uploaded texts, images, videos, etc. within the necessary scope for improving the Service, enhancing its quality, rectifying deficiencies, or promoting the Service, and Users shall not exercise moral rights against this use.
- Except as stipulated in the preceding paragraph, all copyrights and other intellectual property rights related to the Service and all related information belong to the Group or the rights holders who have granted the Group permission to use them, and Users may not duplicate, transfer, lend, translate, modify, reprint, publicly transmit (including making it transmittable), transmit, distribute, publish, or use them for business purposes without prior permission.
Article 9 (Usage Restrictions and Deregistration)

The Group may, without prior notice, delete any data posted by a User, restrict the use of all or part of the Service, or deregister the User if the User or an authorized person with the power to change various settings of a User-owned Discord server falls under or is found to have previously fallen under any of the following:
- Violating any provision of the Terms
- Providing false information during registration
- The credit card registered by the User as a payment method is suspended
- Failing to fulfill payment obligations
- Not responding to communication from the Group within a specified period
- Not using the Service for a specified period after the last use
- Any other cases where the Group deems the use of the Service inappropriate

In the event of any of the circumstances in the preceding paragraph, Users will lose the benefit of the term for all obligations to the Group and must immediately pay all obligations in a lump sum.

The Group assumes no responsibility for any damages incurred by Users due to actions taken by the Group based on this Article.

Users may not circumvent actions taken by the Group based on this Article using methods such as using another account.

Users may file an objection only if they are convinced that the actions taken by the Group based on this Article are due to a mistake by the Group, through the official Discord server or by contacting [email protected]. Even in such cases, the Group reserves the right to freely decide whether to continue the actions taken or to take different actions.
Article 10 (Disclaimer of Warranties and Liability)
- The Group strives to make the Service better, but does not explicitly or implicitly guarantee that the Service is free of factual or legal defects (including defects, errors, bugs, rights infringements, etc. related to safety, reliability, accuracy, completeness, effectiveness, suitability for specific purposes, security, etc.).
- The Group assumes no responsibility for any damages incurred by Users arising from the Service, except in cases of willful misconduct or gross negligence by the Group. However, this disclaimer does not apply if the contract between the Group and the User regarding the Service (including the Terms) constitutes a consumer contract under the Consumer Contract Act.
- Even in the case mentioned in the proviso of the preceding paragraph, the Group assumes no responsibility for any special damages arising from the Group’s negligence (excluding gross negligence) or torts, including cases where the Group or the User foresaw or could have foreseen the occurrence of damages. Furthermore, the Group’s liability for damages caused by the Group’s negligence (excluding gross negligence) or torts is limited to the amount of usage fees received from the User in the month the damages occurred.
- The Group assumes no responsibility for any transactions, communications, or disputes that arise between Users and other Users or third parties in connection with the Service.
Article 11 (Changes to the Terms)
- The Group may change the Terms as necessary due to improvements to the Service or changes in legal requirements. If changes are made, the Group will indicate this on the Terms page and announce it on the official Discord server.
- Continued use of the Service after changes to the Terms constitutes agreement to the revised Terms.
