These Terms of Use (hereinafter referred to as the 'Terms') define the conditions for the use of 'Discope' (hereinafter referred to as the 'Service') provided by Wideplink (hereinafter referred to as 'we', 'us', or 'our') between the user (hereinafter referred to as the 'User') and us.

Users must carefully read and agree to these Terms, as well as the separately defined Privacy Policy, Service Guidelines (Community Guidelines), and any terms regarding paid services (if applicable) before using the Service. By starting to use the Service through Discord account authentication (OAuth2) or by browsing this site, the User is deemed to have agreed to all of these terms.

Article 1 (Definitions)

The definitions of terms used in these Terms are as follows.

  • "The Service": "Discope" operated by Us and all related services (including Discord BOTs provided by Us).
  • "The Site": The website operated by Us to provide the Service.
  • "User": An individual or legal entity who uses the Service by agreeing to these Terms and authenticating via a Discord account, or by browsing the Site.
  • "Account": User identification information on the Service, created and managed through Discord's OAuth2 authentication system, for the User to use the Service.
  • "Posted Information": Information regarding Discord servers (including but not limited to server names, descriptions, keywords, images, etc.), reviews, comments, and any other information posted, transmitted, or displayed by the User using the Service.
  • "User Content": All content created, posted, displayed, or otherwise made available by the User through the Service, including Posted Information.
  • "Intellectual Property Rights": Copyrights, patents, utility model rights, trademark rights, design rights, and other intellectual property rights (including the rights to acquire such rights or to file applications for registration of such rights).
  • "Discord": The communication platform "Discord" provided by Discord Inc.
  • "Discord Terms of Service": Terms regarding the use of Discord established by Discord Inc., such as the Discord Terms of Service (https://discord.com/terms) and Community Guidelines (https://discord.com/guidelines).
  • "Service BOT": The Discord BOT developed and operated by Us to provide and maintain the functions of the Service.

Article 2 (Agreement to Terms)

  • Users shall use the Service in accordance with the provisions of these Terms. You may not use the Service unless you agree to these Terms (including related rules).
  • If a User is a minor, they must obtain the consent of a legal representative, such as a parent or guardian, before using the Service. If a minor who commenced use without the consent of a legal representative reaches the age of majority, they shall be deemed to have ratified their acts of use performed while they were a minor.
  • We may modify these Terms as necessary. The modified Terms shall be notified to Users by posting on this Site or by other methods we deem appropriate. If a User continues to use the Service after such notification, the User shall be deemed to have agreed to the modified Terms. If you do not agree to the changes, please discontinue use of the Service.

Article 3 (Account)

  • To use specific features of the Service, account registration using the Discord OAuth2 authentication system is required.
  • Users shall create an account for the Service using their own Discord account information and shall bear full responsibility for managing their Discord account. We assume no responsibility whatsoever for any damages incurred by the User due to unauthorized use of their Discord account or similar incidents.
  • Users must strictly manage their account information at their own responsibility to prevent unauthorized use.
  • Users must not allow third parties to use their account, nor lend, transfer, change the name of, or sell their account.
  • We shall deem any use of the Service performed through a specific account to be use by the User holding said account.

Article 4 (Use of Service)

  • Users shall use the Service at their own responsibility.
  • The Service provides a platform for users to discover Discord servers, view information regarding them, and join said servers using Discord features.
  • In using the Service, users assume the obligation to comply with the Discord Terms of Service. Acts that violate the Discord Terms of Service, even if conducted on the Service, are prohibited.

Article 5 (Joining Discord Servers)

  • Users may join published Discord servers using Discord OAuth2 authentication or similar methods based on information posted on the Service, at their own discretion and responsibility.
  • Whether or not to join a specific Discord server is entirely the user's own free choice. We do not recommend or compel participation in any specific server.
  • After a user joins a Discord server through the Service, activities within said server (communication, posting/viewing of content, etc.) are conducted within the scope of the Discord service provided by Discord Inc. and shall be subject to the Discord Terms of Service and the rules independently established by said server.

Article 6 (Posting Server Information)

  • Users may post information regarding Discord servers for which they possess administrative authority or legitimate authority to post.
  • Users warrant that posted information is accurate and up-to-date, and does not infringe on the rights of third parties. Provided, however, that users shall endeavor to promptly update posted information if the server's status changes.
  • Users shall not post server information that falls under, or is likely to fall under, any of the following:
    • Servers that violate the Discord Terms of Service or these Terms (including Service Guidelines)
    • Servers containing content that violates laws, regulations, or public order and morals
    • Servers containing content that infringes upon the rights of third parties (intellectual property rights, privacy rights, rights to reputation, etc.)
    • Servers containing content that promotes discrimination, defamation, threats, harassment, or hate speech
    • Servers containing content that constitutes obscenity, child pornography, or child abuse
    • Servers containing excessively violent or cruel content
    • Servers containing content that induces or promotes suicide, self-harm, or the inappropriate use of drugs
    • Servers containing false, misleading, or fraudulent information
    • Servers containing links to harmful programs such as malware or spyware, or servers that distribute such programs
    • Servers whose primary purpose is the collection of personal information
    • Other servers that we determine to be inappropriate in light of the purpose of this Service
  • If we determine that posted information falls under any of the items in the preceding paragraph, or that there is a risk thereof, or if we otherwise deem the information inappropriate, we may take measures to delete, modify, temporarily suspend, or permanently refuse the publication of such information (hereinafter referred to as 'Suspension of Posting, etc.') without prior notice to the User.
  • Regarding servers that have been subject to Suspension of Posting, etc. pursuant to the preceding paragraph, we reserve the right to retain the identification information of such servers (such as Server IDs) for a necessary period, even if the user requests deletion, for the purposes of preventing unauthorized reposting, ensuring service operational necessities, or complying with legal obligations.

Article 7 (User Content)

  • Users shall bear all responsibility for any user content they post or transmit.
  • Intellectual property rights regarding user content belong to the user who created said user content or the legitimate rights holder.
  • However, by posting or transmitting user content using the Service, the user grants us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, create derivative works of, display, and perform such user content within the scope necessary for providing, maintaining, improving, promoting, and developing new services. This license continues to be effective as long as we continue to provide the Service, even after the user terminates use of the Service.
  • The user agrees not to exercise moral rights of authorship against us and those who have succeeded to or been granted rights from us.
  • If we determine that user content violates these Terms, the Privacy Policy, the Service Guidelines (Community Guidelines), or applicable laws, or if we otherwise deem it inappropriate, we may take measures such as deleting, modifying, or restricting the display of such user content without prior notice to the user.

Article 8 (Responsibility Regarding Discord Server Management Authority)

If a user grants a third party management authority or similar authority, including server setting changes, member management, content management, etc., for a Discord server owned or managed by the user, the user shall be jointly and severally liable with the third party for the results of all actions taken by the third party based on that authority (including violations of these Terms, the Discord Terms of Service, and other applicable terms) to us and other third parties, including other users.

Article 9 (Prohibited Matters)

Users must not engage in any of the following acts, or acts that we judge to fall under any of the following, when using the Service. If such acts are confirmed, we may take measures such as suspending or deleting the account based on Article 21.

  • Acts that violate laws, regulations, or public order and morals
  • Acts related to criminal activity or acts that facilitate such activity
  • Acts that violate these Terms, the Privacy Policy, the Service Guidelines (Community Guidelines), or the Paid Service Terms of Use (if applicable)
  • Acts that violate the Discord Terms of Service
  • Acts that infringe upon the intellectual property rights, portrait rights, privacy, honor, reputation, or other rights or interests of us, other users, or third parties
  • Acts that place an excessive load on the network or systems of the Service, or use it for improper purposes
  • Acts that gain or attempt to gain unauthorized access to our network or systems
  • Acts of using the Service with fraudulent or improper intent
  • Acts that may interfere with the operation of the Service (including unauthorized use of bots, intentional exploitation of bugs, etc.)
  • Reverse engineering, decompiling, disassembling, or any other similar acts against our network or systems
  • Acts that gain or attempt to gain unauthorized access to our network or systems
  • Impersonating a third party or intentionally spreading false information
  • Unauthorized use of or attempting to collect other users' account information
  • Acts of using the Service with fraudulent or improper intent
  • Spamming, or manipulating (or attempting to manipulate) the rankings of server lists
  • Acts that cause disadvantage, damage, or discomfort to other users of this service or third parties
  • Providing benefits to or engaging in activities related to anti-social forces
  • Religious or political activities (except as permitted by us)
  • Acts that directly or indirectly induce, facilitate, or encourage any of the preceding acts
  • Any other acts we deem inappropriate

Article 10 (Service Bot)

  • We use our service Bot to provide and improve platform features. By adding the Bot to their servers, the Bot may automatically update server info and collect statistical data.
  • Adding and using the service Bot is optional, though some features may require it.
  • When adding the Bot to a server, users must review and agree to the required permissions (e.g., reading messages, fetching member info). For details on permissions and data collection, see the Privacy Policy or the Bot information page.
  • Users must not use the Bot for illicit purposes or interfere with its operation.

Article 11 (Intellectual Property Rights)

  • All intellectual property rights related to the Site and the Service belong to us or our licensors. The permission to use the Service under these Terms does not imply a license to use any intellectual property rights of us or our licensors related to the Site or the Service. This includes intellectual property rights such as copyrights for original characters created and published by us in connection with the Service (hereinafter referred to as 'the Characters'), all of which belong exclusively to us.
  • Users shall not reproduce, transfer, lend, translate, modify, reprint, publicly transmit (including making transmittable), transmit, distribute, publish, or use for commercial purposes any content included in the Service (excluding User Content, but including the Characters) without our prior consent. However, this does not apply to fan activities within the scope of our 'Fan Work Guidelines.' When engaging in fan activities, please ensure you review and comply with those guidelines.

Article 13 (Privacy)

We handle your privacy and personal information appropriately according to our 'Privacy Policy'. We strive to comply with applicable data protection laws, including the GDPR. You must review and agree to the Privacy Policy before using our services.

Our services may use third-party advertising partners who collect and use information to deliver ads. Please see our Privacy Policy for details.

Article 14 (Service Guidelines)

We may establish specific rules and recommendations as 'Service Guidelines' (e.g., Community Guidelines). You must comply with these Service Guidelines alongside these Terms.

Article 15 (Third-Party Services)

The Service may contain links to services or content provided by third parties other than us, including Discord and Google AdSense (an advertising delivery service). We assume no responsibility for such third-party services or content. Users shall use these services or content at their own risk.

Article 16 (Disclaimer)

  • We make no warranties, express or implied, regarding the completeness, accuracy, timeliness, safety, usefulness, fitness for a particular purpose, or non-infringement of third-party rights with respect to the Service (including the website, posted information, and the Service bot).
  • We endeavor to maintain the accuracy and timeliness of all listings; however, as information is updated by server operators at their discretion, we do not guarantee that the content on this service will always reflect the actual status of a Discord server (including its rules, atmosphere, membership, or activities). Users join servers at their own discretion. We shall not be liable for any disadvantage or damage arising from discrepancies between listed information and the actual server environment, including but not limited to expectations not being met or the existence of unforeseen rules.
  • While this service facilitates the discovery of Discord servers, all activities within those servers (including but not limited to user communication, posts, disputes, moderation actions, and content issues) occur on the Discord platform and are beyond our control. Consequently, we have no obligation to monitor or intervene in, and assume no liability for, any troubles or damages occurring within joined Discord servers. Users must address any issues regarding server-internal activities directly to the respective server operator or Discord Inc.
  • We do not warrant that the Service will be uninterrupted or error-free, or that emails, content, Service Bots, or other materials transmitted in connection with the Service are free of harmful components such as computer viruses.
  • Users shall use the Service at their own risk. We shall not be liable for any damages incurred by users arising from the use of the Service (including joining servers via the Service), including but not limited to disputes between users, computer damage, data loss, or damages resulting from the installation or use of Service Bots. However, this limitation shall not apply to damages caused by our willful misconduct or gross negligence.
  • Some or all functions of the Service may become unavailable due to changes in Discord's specifications, API availability, or other external factors. We assume no responsibility for any damages incurred by users as a result of such unavailability.

Article 17 (Limitation of Liability)

Even if we are held liable for any reason, we shall not be liable for any incidental, indirect, special, or future damages, or for any lost profits incurred by the user. Furthermore, our total aggregate liability shall be limited to the total amount of fees (if any) we have received from the user in connection with the event that directly caused such damages. However, this limitation shall not apply in cases of our willful misconduct or gross negligence.

Article 18 (Indemnification)

You agree to indemnify and hold us harmless from and against any and all claims, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to your violation of these Terms (including related policies), your infringement of third-party rights, or your use of the Service (including posting user content, listing server information, or using our bot).

Article 19 (Amendments)

As set forth in Article 2, Paragraph 3.

Article 20 (Modification, Suspension, and Termination of Service)

  • We may modify the content of the Service or terminate its provision at our discretion. In the event of termination, we will generally notify users in advance.
  • We may temporarily suspend the provision of all or part of the Service without prior notice if any of the following occur:
    • When necessary for unavoidable maintenance or construction of Service facilities or the Service Bot.
    • When unavoidable failure occurs in Service facilities or the Service Bot.
    • When providing the Service becomes difficult due to Discord API limits, specification changes, outages, or similar issues.
    • When telecommunication services become unavailable due to issues with the telecommunications carrier.
    • When providing the Service becomes difficult or impossible due to force majeure events such as natural disasters, fires, power outages, civil disturbances, or other emergencies.
    • If the provision of the Service becomes difficult or impossible due to measures based on laws and regulations, etc.
    • In other cases where we determine it is unavoidable.
  • We assume no responsibility for any damages incurred by users as a result of measures taken by us based on this Article.

Article 21 (Suspension and Deletion of User Accounts)

  • If we determine that a user falls under or is likely to fall under any of the following, we may, without prior notice, take measures such as deleting user content, suspending use of the Service in whole or in part, deleting the account, or terminating the service agreement (hereinafter 'Account Suspension, etc.').
    • If you violate any of the provisions of these Terms (including related terms).
    • If it is discovered that registration information or posted information contains false information.
    • In the event of suspension of payment or insolvency, or if a petition is filed for the commencement of bankruptcy proceedings, civil rehabilitation proceedings, corporate reorganization proceedings, special liquidation, or any other similar proceedings (in the case of using paid services).
    • If your Discord account is suspended or deleted.
    • If there has been no use (logging in, etc.) of the Service for more than six months.
    • If you do not respond to our inquiries or other requests for a response for more than six months.
    • If you engage in any of the acts specified in Article 9 (Prohibited Conduct).
    • If we determine that the same user has created multiple accounts and is using them for inappropriate purposes.
    • If it is found that the user has previously been subject to Account Suspension, etc. by us.
    • In any other case where we determine that your continued use of the Service is inappropriate.
  • If any of the items in the preceding paragraph apply, you will automatically lose the benefit of time regarding all debts owed to us and must immediately pay all such debts to us (in the case of using paid services).
  • We assume no liability for any damages incurred by the user due to measures taken under this Article. Furthermore, we are under no obligation to disclose the reasons for Account Suspension, etc.
  • Regarding users subject to Account Suspension, etc. under Paragraph 1, we may retain identification information (such as Discord User IDs) for a necessary period—even upon a deletion request—to prevent unauthorized re-registration or abuse, for operational necessities, or to comply with legal obligations.

Article 22 (Governing Law and Jurisdiction)

  • The formation, validity, performance, and interpretation of these Terms and the service usage agreement shall be governed by the laws of Japan.
  • In light of the fact that the Service may be provided internationally and that Discord Inc. is based in California, the parties acknowledge that laws outside of Japan, including California law, may apply in connection with these Terms. However, as a general rule, Japanese law as specified in the preceding paragraph shall apply.
  • Any and all disputes arising out of or in connection with these Terms or the service use agreement shall be submitted to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

Article 23 (Severability)

Even if any provision of these Terms or a part thereof is determined to be invalid or unenforceable under applicable laws and regulations, the remaining provisions of these Terms and the remaining parts of any provision determined to be invalid or unenforceable in part shall continue to be in full force and effect.

Article 24 (Entire Agreement)

These Terms, together with the separately established Privacy Policy, Service Guidelines (Community Guidelines), and Paid Service Terms of Use (where applicable), constitute the entire agreement between us and the user regarding this Service and supersede all prior agreements, representations, and understandings, whether oral or written, between us and the user regarding this Service.

Article 25 (Language)

These Terms are prepared in Japanese as the official text. Even if translations in other languages are created for reference convenience, only the Japanese official text shall be effective as a contract, and translations shall not have any effect. In the event of any contradiction or conflict between the Japanese official text and a translation, the Japanese content shall prevail.

Article 26 (Contact Information)

Article 27 (Advertising)

  • Our services are funded by advertising revenue, which allows users to use our services free of charge in principle. By using our services, users agree that third-party advertisements will be displayed on this site or within our services.
  • We partner with third-party distribution providers, including Google AdSense (hereinafter referred to as "Advertising Partners"), to display advertisements within our services.
  • Advertising Partners may use information such as user cookies, device IDs, IP addresses, and browsing history within our services to display advertisements tailored to the user's interests (personalized advertisements).
  • To comply with regulations in the European Economic Area (EEA) and other regions, our services have implemented Google Consent Mode v2, which appropriately controls the operation of advertising delivery and measurement tags based on the user's consent status.
  • Users may opt out of or manage the display of personalized advertisements through any of the following methods.
    • Change your settings in Google Ads Settings (https://myadcenter.google.com/)
    • Withdraw or change your consent via the "Cookie Settings" (Cloudflare Zaraz Consent Management Tool) located on our site
    • Configure your settings on the opt-out pages of advertising industry groups such as YourOnlineChoices or AboutAds.info
  • For content displayed in advertisement or sponsored slots within search result lists, server lists, or other display positions in our service, we will clearly distinguish them from regular server listings (organic search results) by including labels such as "Ad", "PR", or "Sponsored".
  • For users who have subscribed to our paid services, advertisements may be hidden under separately defined conditions. For details, please refer to the Paid Service Terms of Use.
